These Terms of Service ("Terms") govern your use of ATS CV Checker, including the Chrome browser extension, the web application at www.atscvchecker.pro, and any related services (collectively, the "Service"). ATS CV Checker is an independent project operated by an individual developer ("we", "us", "our").
By installing the Chrome extension, accessing the website, or using any part of the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
1. Description of Service
ATS CV Checker is a free Chrome browser extension and web application that provides:
- Real-time ATS resume scoring on job listing pages
- Keyword gap analysis comparing your resume to job descriptions
- AI-powered CV generation tailored to specific job descriptions
- AI-powered cover letter generation
- Job application tracking
The extension is available in 52 languages through the Chrome Web Store. ATS scoring and keyword analysis features are provided free of charge and run locally in your browser. AI generation features require server processing.
2. Eligibility
You must be at least 13 years old to use this Service (16 in jurisdictions where the GDPR applies and the member state has set the age of consent for data processing at 16). By using the Service, you represent that you meet these age requirements. ATS CV Checker is designed for adult job seekers.
3. User Accounts
No account is required to use the core features of ATS CV Checker. If you choose to create an account for the web application:
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate and current information.
- You may delete your account at any time by contacting us at support@atscvchecker.pro.
We reserve the right to suspend or terminate accounts that violate these Terms. Upon account termination, your stored data will be deleted from our servers within 30 days.
4. Acceptable Use
You agree to use ATS CV Checker only for legitimate purposes. Specifically, you agree to:
- Use the Service for genuine job searching and resume optimization only.
- Not fabricate qualifications — Do not use the AI generation features to create false credentials, fake work experience, invented degrees, or other misleading information. You are responsible for ensuring your resume content is truthful.
- Not abuse the Service — Do not use automated scripts, bots, or other means to generate excessive requests that could degrade the service for other users.
- Not reverse-engineer — Do not attempt to decompile, disassemble, or extract the source code of the extension or backend services.
- Not circumvent restrictions — Do not attempt to bypass any usage limits, rate limits, or access controls.
- Not use for harmful purposes — Do not use the Service for spam, phishing, harassment, or any unlawful activity.
Violation of these terms may result in suspension of your access to the Service.
5. AI-Generated Content
ATS CV Checker uses artificial intelligence (OpenAI GPT-4o) to generate tailored CVs and cover letters. By using these features, you acknowledge and agree that:
5.1. Accuracy and Verification
- AI-generated content is a starting point, not a final product. You must review and verify all generated content before using it in job applications.
- AI may occasionally produce inaccurate, incomplete, or inappropriate content. This includes but is not limited to: incorrect dates, misrepresented skills, fabricated achievements, or irrelevant information.
- You are solely responsible for the accuracy and truthfulness of any application materials you submit to employers, regardless of whether the content was AI-generated.
5.2. No Guarantee of Results
- We do not guarantee that AI-generated CVs or cover letters will result in job interviews, offers, or employment.
- We do not guarantee that AI-generated content will pass any specific Applicant Tracking System. ATS algorithms vary by employer and software vendor, and their criteria are not publicly disclosed.
- The effectiveness of any resume depends on many factors beyond our control, including the job market, employer preferences, your qualifications, and competition.
5.3. Your Responsibility
Submitting misleading, false, or exaggerated information in job applications may violate laws in your jurisdiction and could result in termination of employment if discovered. We strongly encourage you to use AI-generated content as a framework and customize it to accurately represent your genuine experience and qualifications.
6. Not Professional Advice
ATS CV Checker provides automated resume analysis and AI-generated suggestions. The Service does not constitute:
- Career counseling — We do not provide professional career advice. Our suggestions are algorithmic, not based on professional career counselor assessment.
- Employment guidance — We do not guarantee employment outcomes. ATS scores are estimates based on common ATS patterns, not exact predictions of how any specific ATS will evaluate your resume.
- Legal advice — We do not provide legal advice regarding employment law, discrimination, or labor regulations in your jurisdiction.
If you need professional career guidance, we recommend consulting a qualified career counselor or resume writer.
7. Intellectual Property
7.1. Our Intellectual Property
The Service, including its design, code, algorithms, user interface, graphics, documentation, and all related content, is owned by ATS CV Checker and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our written permission.
7.2. Your Content
You retain full ownership of your resume content, CV profile data, and any information you provide to the Service. We do not claim any intellectual property rights over your data.
By using the AI generation features, you grant us a limited, temporary, non-exclusive license to process your data solely for the purpose of generating the requested output. This license terminates immediately upon completion of the generation request. We do not store your content beyond the processing window.
7.3. AI-Generated Output
CVs, cover letters, and other content generated by the AI based on your profile and job descriptions are yours to use as you see fit. We do not claim ownership of AI-generated output. However, similar outputs may be generated for other users with similar inputs, as the AI model is shared.
8. Service Availability
The Service is provided on an "as is" and "as available" basis. We make our best effort to keep the Service running smoothly, but as an independent project, we cannot guarantee uninterrupted availability. Specifically:
- We do not guarantee any specific uptime percentage or service level.
- The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.
- AI generation features depend on third-party services (OpenAI) and may be affected by their availability.
- We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
- Browser-based features (ATS scoring, keyword analysis) will continue to work offline or when our servers are unavailable, as they run locally.
9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- The Service is provided without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Service will meet your requirements, be error-free, or produce accurate results.
- We do not warrant that ATS scores reflect how any particular employer's ATS will evaluate your resume.
- We do not warrant the accuracy, completeness, or reliability of any AI-generated content.
Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply only to the extent permitted by law. If you are a consumer in the European Union, this section does not affect your statutory consumer rights under EU law.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- ATS CV Checker and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of employment opportunities, loss of income, loss of data, emotional distress, or any other damages arising from your use of or inability to use the Service.
- Our total aggregate liability to you for any and all claims arising from your use of the Service shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $10 USD.
- This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
For EU consumers: Nothing in these Terms limits or excludes our liability for damages caused by intent or gross negligence, or any liability that cannot be limited or excluded under applicable EU consumer protection law. Your statutory consumer rights remain unaffected.
For UK consumers: Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
11. Indemnification
You agree to indemnify and hold harmless ATS CV Checker and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service in violation of these Terms.
- Your submission of false or misleading information in job applications using content generated by the Service.
- Your violation of any applicable law or third-party rights.
This indemnification provision does not apply to the extent prohibited by applicable consumer protection law in your jurisdiction.
12. Third-Party Services
The Service integrates with third-party services, including:
- OpenAI — Powers AI CV and cover letter generation. Subject to OpenAI's Terms of Use.
- Chrome Web Store — Distribution platform for the extension. Subject to Google's Terms of Service.
- Job platforms (LinkedIn, Indeed, Glassdoor, etc.) — The extension operates on these sites but is not affiliated with or endorsed by them. You must comply with each platform's terms of service when using them.
We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies.
13. Privacy
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
14. Modifications to the Service
We are continuously improving ATS CV Checker. We reserve the right to:
- Add, modify, or remove features at any time.
- Change the scope of free and paid features.
- Update the AI models used for generation.
- Modify supported job platforms and languages.
We will make reasonable efforts to communicate significant changes through extension update notes on the Chrome Web Store or on our website.
15. Termination
By you: You may stop using the Service at any time by uninstalling the Chrome extension and, if applicable, deleting your account. No notice is required. Your locally stored data will be deleted when you uninstall the extension.
By us: We may suspend or terminate your access to the Service if you violate these Terms, abuse the Service, or engage in behavior that harms other users or our infrastructure. Where possible, we will provide notice before termination.
Upon termination, sections of these Terms that by their nature should survive will continue to apply, including: Sections 5 (AI-Generated Content), 7 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), and 17 (Governing Law).
16. Changes to These Terms
We may update these Terms from time to time. When we make changes:
- We will update the "Last updated" date at the top of this page.
- For material changes that significantly affect your rights, we will make reasonable efforts to notify you (e.g., through the Chrome Web Store update notes or a notice on our website).
- Continued use of the Service after the updated Terms are posted constitutes your acceptance of the changes.
- If you do not agree with the updated Terms, you should stop using the Service.
17. Governing Law and Dispute Resolution
17.1. General
These Terms shall be governed by and construed in accordance with applicable law. We encourage you to contact us first to resolve any disputes informally before pursuing formal proceedings. Most concerns can be resolved quickly through a good-faith conversation.
17.2. For EU/EEA Consumers
If you are a consumer in the European Union or European Economic Area, nothing in these Terms affects your rights under mandatory EU consumer protection laws, including Directive 2011/83/EU (Consumer Rights Directive). Any disputes shall be subject to the jurisdiction of the courts of your country of residence, as provided by EU Regulation 1215/2012. You may also use the EU Online Dispute Resolution platform.
17.3. For UK Consumers
If you are a consumer in the United Kingdom, these Terms are governed by the laws of England and Wales. You may bring legal proceedings in the courts of your country of residence within the UK.
17.4. For Brazilian Users
If you are a consumer in Brazil, these Terms are subject to the Brazilian Consumer Defense Code (Codigo de Defesa do Consumidor) and the LGPD. Disputes shall be resolved in the courts of your domicile.
17.5. For All Other Users
For users not covered by the above provisions, any disputes arising from these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of a recognized arbitration body, or resolved in the courts of competent jurisdiction in the Netherlands.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ATS CV Checker regarding your use of the Service. They supersede any prior agreements or communications regarding the Service.
